Welcome to Turnkey Racing Sims. These Terms of Service ("Terms") govern your use of our website at turnkeyracingsims.com and any related services (collectively, the "Service") operated by Prodigy Technology Solutions LLC, doing business as Turnkey Racing Sims ("Turnkey," "we," "us," or "our"). By accessing or using our Service, you agree to be bound by these Terms. If you don't agree, please don't use the Service.

1. Eligibility

You must be at least 18 years old to use our Service or make a purchase. By using the Service, you represent that you meet this age requirement and that all information you provide is accurate and complete.

2. Accounts

When you create an account with us (hosted through Shopify), you're responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Please use a strong password and notify us immediately if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

3. Products and Pricing

We sell curated racing simulator packages and related components, accessories, and add-ons. All product descriptions, images, and specifications are provided as accurately as possible, but we do not warrant that they are error-free. We reserve the right to correct any errors in pricing or product information, even after an order has been placed.

Prices are listed in U.S. dollars and do not include applicable sales tax, which will be calculated at checkout based on your shipping address. We reserve the right to change prices at any time without prior notice, though price changes will not affect orders that have already been confirmed.

4. Orders and Payment

When you place an order, you are making an offer to purchase. We reserve the right to accept or decline any order for any reason, including product availability, pricing errors, or suspected fraud. Once we confirm your order via email, a binding agreement is formed.

Payment: Full payment is required at checkout unless you choose to finance through an approved third-party financing provider. We accept major credit cards, debit cards, PayPal, and approved financing options. All payments are processed through secure, PCI-compliant third-party payment processors.

Financing: If you finance your purchase through a third-party provider, your financing agreement is between you and that provider. Their terms, rates, and conditions apply. Turnkey is not a party to your financing agreement and is not responsible for any disputes between you and the financing provider.

5. Order Cancellation and Modification

We understand plans change. Here's how cancellations and modifications work:

  • Within 24 hours of order placement: You may cancel or modify your order at no cost by contacting us at support@turnkeyracingsims.com, provided the order has not yet entered our fulfillment process.
  • After 24 hours or once in fulfillment: Orders that have entered fulfillment (picking, packing, or shipping) cannot be cancelled or modified. You may still return the order after delivery per our Return Policy.
  • Restocking fee: Cancellations approved after the 24-hour window but before shipment may be subject to a restocking fee of up to 15% of the order total to cover handling and processing costs.

To request a cancellation or modification, email support@turnkeyracingsims.com with your order number. We'll confirm whether your order is eligible.

6. Shipping

7. Returns and Refunds

8. Warranty

Products sold by Turnkey are covered by their respective manufacturer warranties. Turnkey serves as your point of contact for warranty inquiries and will coordinate with the manufacturer on your behalf. Please see our Warranty Information page for details.

9. Intellectual Property

All content on our website — including text, images, graphics, logos, product photography, videos, guides, and other materials — is owned by or licensed to Prodigy Technology Solutions LLC and is protected by U.S. and international copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from our content without our prior written consent.

The Turnkey Racing Sims name, logo, and tagline are trademarks of Prodigy Technology Solutions LLC. All third-party product names, brand names, and logos referenced on our site belong to their respective owners and are used for identification purposes only.

10. User-Generated Content

Our Service may allow you to submit content, including product reviews, setup photos, forum posts, and community contributions ("User Content"). By submitting User Content, you:

  • Represent that you own or have the rights to the content you submit
  • Grant Turnkey a non-exclusive, royalty-free, worldwide, perpetual license to use, display, reproduce, modify, and distribute your User Content in connection with our Service and marketing (for example, featuring your setup photo on our website or social media)
  • Agree not to submit content that is illegal, defamatory, harassing, infringing, misleading, or otherwise objectionable

We reserve the right to remove any User Content at our discretion. We are not responsible for User Content submitted by others.

11. Prohibited Uses

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Scrape, mine, or collect data from the Service without written permission
  • Impersonate another person or entity
  • Submit false or misleading information
  • Use the Service to distribute malware or other harmful code
  • Engage in any conduct that restricts or inhibits others from using the Service

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT PERMITTED BY LAW, TURNKEY DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

While we take great care in curating our packages and verifying component compatibility, we do not manufacture any of the components we sell. Product performance, specifications, and quality are ultimately the responsibility of the respective manufacturers.

13. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY CALIFORNIA LAW, PRODIGY TECHNOLOGY SOLUTIONS LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SERVICE OR PURCHASE OF PRODUCTS, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR GOODWILL. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SPECIFIC PRODUCT OR SERVICE GIVING RISE TO THE CLAIM.

14. Indemnification

You agree to indemnify, defend, and hold harmless Prodigy Technology Solutions LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

15. Dispute Resolution

Governing law: These Terms are governed by the laws of the State of California, without regard to conflict of law principles.

Informal resolution first: Before filing any formal claim, you agree to contact us at support@turnkeyracingsims.com and attempt to resolve the dispute informally for at least 30 days.

Binding arbitration: If informal resolution fails, any dispute arising from these Terms or your use of the Service will be resolved through binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration will take place in San Diego County, California, and the arbitrator's decision will be final and enforceable in any court of competent jurisdiction.

Small claims exception: Either party may bring an individual action in small claims court in San Diego County, California, if the claim qualifies.

No class actions: You agree to resolve disputes with us on an individual basis only. You waive any right to participate in a class action, class arbitration, or representative proceeding.

16. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on our site with an updated effective date, and we'll notify registered account holders by email. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
